The context of the selected article
The selected article for this assignment is focused on the roles and jurisdiction of state courts as well as the supreme court. What powers a state court held and whether the decision of the supreme court will supersede of all the decisions of lower courts is the topic of debate, contended in the assignment. This debate has made in relation to the abortion rights in the Louisiana state of Unite state.
Summary of the Article
In the chosen article, the author stated that recently a group of people who supports the right of abortion argued that the federal appellate court must rehear the case and think about the decision taken by the same. The judges of appellate court upheld the abortion rights. Now, the center for reproductive rights argued that the decision given by the judges must rehear as the same violated the Supreme Court precedent. The center further argued that everybody knows that decisions of supreme courts are binding on the lower courts, so as the similar law in Texas was unconstitutional, how the same can be concluded constitutional in Louisiana. At last, by providing many another basis of their request, the center stated that they will fight for the access to abortion rights in the state of Louisiana.
Analysis
The article is much relevant for many groups such as regulator, government, and entrepreneurs. The jurisdiction of courts is a topic that everyone must be aware of. Until unless one will not be clear that which court is responsible and entitled to hear which kind of cases, the justice will be delayed (Find Law, 2018). Further, for the courts too it is necessary to look after their powers and to consider the decisions of superior courts while making any judgment (Judicial Learning Centre, 2018).
